Welcome to the Spanx Icon Rewards Program (“Program”). Please read this document carefully. SPANX, LLC (“Spanx,” “we,” “our,” or “us”) offers this optional Program to reward loyal Spanx customers for purchasing our products. By joining the Program, you (individually “you,” “your,” or “Member'') agree that you have read, understood, and agree to be bound by these Spanx Icon Rewards Program Terms and Conditions (“Program Terms”). Spanx reserves the right to update or modify these Program Terms at any time without prior notice.
PLEASE BE AWARE THAT THESE PROGRAM TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER THAT GOVERN HOW DISPUTES BETWEEN YOU AND SPANX RELATING TO THE PROGRAM MUST BE RESOLVED. PLEASE READ THIS SECTION CAREFULLY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.
By participating in the Program, you acknowledge that you have read, understand and consent to the Terms of Use and Privacy Policy, which are incorporated into and made part of this contract.
Privacy
Our Privacy Policy explains what information we collect about, why we use it, who we share it with, and how we protect it. When you join the Program and provide us with your email address, you also opt-in to receive marketing emails from us. To stop receiving marketing emails from us, click the “unsubscribe” link at the bottom of any marketing email. Please note, even if you opt-out of receiving marketing emails from us, we will continue to send you transactional emails regarding the Program.
Membership Eligibility
In order to participate in the Program, you must: (i) be at least eighteen (18) years of age; (ii) be a legal U.S. resident and (iii) have a valid email address. The Program is free to join and intended for personal use only. Spanx may deny membership at its sole discretion and without prior notice.
Only individuals are eligible to participate; corporations, groups, and associations are not eligible to participate in the Program.
Spanx employees and individuals employed by our business partners or vendors are eligible to become a Member (for personal purchases only), but may be excluded from being eligible for certain benefits under the Program.
Membership Tier Levels
The Program consists of multiple levels, including Star, A-List and VIP (the “Tiers”). Tiers are defined by the qualifying net purchase amounts (“Qualifying Purchase”) or the number of Qualifying Purchases made since January 1st of the prior calendar year. A Qualifying Purchase is defined as a purchase made on Spanx.com, excluding returns, order cancellations, purchases for resale, sales tax, shipping and handling fees, purchase of Spanx gift cards, redeemed rewards and other discounts. Upgrades to the next Tier and corresponding rewards will be processed thirty (30) days after qualifying.
The requirements for each Tier are:
Star: No Minimum Qualifying Purchase required. All Members are eligible for the Star Tier upon enrollment, unless they make a Minimum Qualifying Purchase to upgrade to the A-List or VIP Tier.
A-List: Minimum Qualifying Purchase of $250 OR minimum of two (2) Qualifying Purchases since January 1st of the prior calendar year.
VIP: Minimum Qualifying Purchase of $400 OR minimum of four (4) Qualifying Purchases since January 1st of the prior calendar year.
Eligibility is valid for the calendar year in which the Member qualifies and the following full calendar year; after that annual requalification is required. A-List and VIP Members who do not requalify will be moved to the Star Tier.
Redeeming Rewards
As a Member, your rewards are based on the Tier you are qualified for. To redeem Member offers and rewards, you must be qualified in the relevant Tier to take advantage of the particular benefit. Specific rewards are available while supplies last. Rewards are non-transferable, have no cash value (unless required by law), and cannot be returned, exchanged or sold. We reserve the right, without notice, to cancel or reduce the quantity of any order to be filled and/or any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of the Program Terms.

Birthday Reward
All Members are eligible to receive one (1) Birthday Reward per year on their birthday. The Birthday Reward is $20 off any purchase of $200 or more in the form of a discount code. Reward is valid only toward SPANX® brand styles on www.spanx.com. Discount code must be applied at checkout to redeem reward. Reward expires thirty (30) days following the birthdate provided at the time of sign-up. Reward not valid at other retail outlets. Not valid for purchase for resale. No adjustments on previous purchases. Reward is void where taxed, restricted or prohibited by law. Reward is non-transferable, not redeemable for cash, and subject to change without notice. Level-Up Reward: Discount Code
A-List and VIP Members will receive one (1) special welcome offer in the form of a discount code. Please note, VIP Members who have already received a welcome offer as part of their A-List status will not receive an additional welcome offer upon reaching VIP status. Offer valid only toward SPANX® brand styles on www.spanx.com. Discount code must be applied at checkout to redeem reward. Offer expires December 31 at 11:59PM ET. First to Know about Select Product Launches & Sales
Members are in the first to know regarding upcoming product launches and sales. This reward ensures that Members stay ahead of the curve, giving them the opportunity to purchase newly released items or take advantage of promotions before they are marketed to non-members.
Exclusive Sales
Members gain access to sales that are reserved only for Members.
Exclusive Gifts
Members receive special gifts, which may include free products or exclusive items not available for regular purchase. One featured benefit is our "Every 10th Panty Free" offer. For every nine individual panties purchased or three 3-count panty bundles, the 10th panty is free. Offer redeemable for panties valued at $26 or less. All gifts are available while supplies last. Discount codes for gifts will be issued and redeemable thirty (30) days following a Qualifying Purchase. Exclusive gifts are non-transferable, have no cash value (unless required by law), and cannot be returned, exchanged or sold.
Priority Customer Support
A-List and VIP Members have access to priority customer support. This reward is designed to offer personalized recommendations, shopping assistance, and tailored experiences to elevate our Members interactions with Spanx.
Extended 60-Day Returns Window
VIP Members have access to an extended returns window of sixty (60) days (compared to the regular 30-day window), providing them with greater flexibility and convenience when making purchasing decisions.
Returns on Final Sale Styles
Unlike standard policies that restrict returns on final sale items, this reward allows VIP Members to return these purchases, provided that certain exclusions may apply (e.g., personalized items).
Priority Order Processing
VIP Members benefit from expedited order fulfillment, ensuring that purchases are processed and shipped faster than non-members.
Invites to VIP In-Person Events
VIP Members may receive invitations to brand-hosted in-person events, such as fashion shows, product launch parties, or private shopping experiences.
We reserve the right to modify these Program Terms, the conditions for reaching each Tier, and how we evaluate and reward your eligible purchases and/or other Program activity. We reserve the right to place limits on the number of purchases or activities that are eligible for any Tier, the number or types of rewards or benefits you may receive or earn in any given Tier in a given time period or for the duration of the Program, and/or any combination thereof.
Program Communication
For Program eligibility, Members must provide an email address at the time of sign-up. Notifications regarding the Program, including Tier status, rewards, benefits and promotions will be sent to this email address. We are not responsible for communications sent to an invalid email address, so please keep your email address up to date.
If you have concerns that a purchase or other activity was not properly applied to your account, contact us via email at contactus@spanx.com. Your email must specify your name and email address associated with the Program, the date of the Program activity, and the issue(s) you encountered. This email must be sent no more than thirty (30) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about prior purchases or other Program activities not being credited to an account due to such delay.
Termination and Modification
The Program and its benefits are offered at our sole discretion. We may cancel, modify, restrict, or terminate any Program Terms or the Program at any time without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and such termination or modification may affect your ability to redeem rewards or benefits you have already accumulated under the program.
We reserve the right to exclude you from, or to discontinue your participation in, the Program and to audit your Membership account at any time, at our sole discretion, and without prior notice. This includes, but is not limited to, suspected abuse of the Program, failure to follow any Program Terms, making purchases under your account for business or resale purposes, excessive returns, creating or maintaining multiple accounts using different email addresses, engaging in illegal activity, fraud, misrepresentation, or engaging in other conduct inconsistent with these Program Terms, may result in the revocation of your Membership and make you ineligible for further participation in the Program. If your Membership is revoked, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect you or someone using your account credentials engaged in illegal activity, fraud, misrepresentation, abuse or violation of these Program Terms or others governing use of the Site, you understand and agree that we have the right to take appropriate legal action, including actions involving law enforcement, in our sole discretion.
If you are dissatisfied with the Program, termination of your Membership in the program is your sole remedy. You may cancel your Membership at any time by emailing customer service at contactus@spanx.com.
Limitation of Liability and Indemnification
You agree that Spanx will be not liable for any indirect, special, punitive, incidental, or consequential damages of any kind (including lost profits) related to the Program, whether in contract, warranty or in tort, including for any (a) inaccuracies or omissions in program content; (b) access delays or access interruptions to the Program; or (c) events beyond our reasonable control.
You agree to defend, indemnify, and hold Spanx harmless for any loss, damages, or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your participation in the Program in violation of any law, rule, regulation or these Program Terms.
Governing Law and Disputes
This Program and these Program Terms will be governed by and construed under the substantive laws of the State of Georgia, as if they were a contract wholly entered into and wholly performed within Georgia and without reference to conflict-of-laws considerations.
YOU UNDERSTAND AND AGREE THAT ANY DISPUTE RELATING TO OR ARISING UNDER THIS PROGRAM, THE PROGRAM TERMS, AND YOUR MEMBERSHIP, OR INVOLVING ANY OF THE FOREGOING AMONG OTHER DISPUTES, SHALL BE RESOLVED THROUGH CONFIDENTIAL ARBITRATION IN GEORGIA. IN RETURN FOR THE BENEFITS YOU OBTAIN FROM YOUR PARTICIPATION IN THE PROGRAM, YOU AGREE TO SUBMIT YOURSELF TO THIS JURISDICTION AND TO RESOLVE DISPUTES THROUGH THIS ARBITRATION PROCESS. ARBITRATION MEANS THAT A SINGLE ARBITRATOR WILL DECIDE THE CLAIM, AND YOU WILL NOT HAVE THE RIGHT TO SUE IN COURT OR TO HAVE A JUDGE OR JURY DECIDE YOUR CLAIM. YOUR RIGHTS TO PREHEARING EXCHANGE OF INFORMATION AND APPEALS MAY ALSO BE LIMITED IN ARBITRATION. You also understand and agree that any dispute over the scope of this arbitration provision and any dispute as to whether a claim can be arbitrated shall be submitted to the arbitrator for decision. Notwithstanding the foregoing, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners, or licensors, or otherwise give rise to our cause of action in equity, we may seek injunctive or other appropriate relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for such purposes. Arbitration under these Program Terms shall be conducted under the Consumer-Related Disputes Supplementary Rules then prevailing with the American Arbitration Association. The arbitrator's award shall be binding on you and us and it may be entered as a judgment in any court of competent jurisdiction. You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually, and (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. YOU UNDERSTAND AND AGREE THAT YOU MAY ONLY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
