Spanx may, from time to time, offer our customers and users of our website the opportunity to receive rewards toward future purchases from Spanx.com by referring other real people (“Program”). The Program is enabled through technology provided by Friendbuy, Inc., 7083 Hollywood Blvd. 1st Floor, Los Angeles, CA 90028 (“Platform Provider”). If you choose to participate in the Program, you are subject to Spanx’s website Terms & Conditions and Spanx’s Privacy Policy (both available on our website) as well as the following additional Referral Program Terms & Conditions:
- Referrer. A “referrer” is a real person who refers other real people to www.spanx.com using the Personal Referral link provided by Spanx. To participate as a Referrer, follow the instructions you received via email from Spanx to refer others to the website. You may refer up to five (5) friends. A Referrer may be eligible to receive “Referral Reward(s)” (defined below) for up to three (3) “Qualified Referrals” (defined below).
- Referred Customer. A Referred Customer is defined as a real person who visits our website by clicking the Personal Referral link shared by a Referrer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). A Referred Customer will receive 15% off of a single online purchase at www.spanx.com of any full-price Bra-llelujah!® bra.
- Qualified Referral. A Qualified Referral is defined as a purchase made at www.spanx.com of a full-price Bra-llelujah!® bra by a Referred Customer. Referrers are limited to one Referral Reward for each Qualified Referral; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals and will not earn additional Referral Rewards. A Qualified Referral does not include purchases cancelled within 24 hours. Spanx, in its sole discretion, has the right to determine whether or not a Referrer has made a Qualified Referral based on adherence to these Terms & Conditions.
- Referral Reward. Referral Rewards are earned as the result of Qualified Referrals only. The Referrer shall receive one (1) Referral Reward valued toward future purchases at spanx.com for up to three (3) valid and verified Qualified Referrals generated by that Referrer. Referral Rewards for this Program may be awarded as follows: (1) after the first Qualified Referral, 20% off the purchase of $75 or more on www.spanx.com; (2) after the second Qualified Referral, $25 off the purchase of $75 or more on www.spanx.com; and (3) after the third Qualified Referral, $40 off the purchase of $75 or more on www.spanx.com. Referral Rewards may not be combined and are only valid for one-time use. Referral Rewards are not valid at any other retail outlets, SPANX® brand retail stores, or SPANX® brand airport stores. Referral Rewards may not be used to adjust previous purchases and are void where taxed, restricted or prohibited by law. Referral Rewards may not be used for purchase for resale. Referral Rewards are non-transferable, are not redeemable for cash, and are subject to change without notice. Referral Rewards cannot be combined with other offers or discounts. Referral Rewards must be used prior to any specified expiration date. Referral Rewards are determined by Spanx and are subject to change at Spanx’s sole discretion.
- Reward Payments. No more than three (3) Referral Rewards will be awarded for this Program. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards.
- Eligibility. Eligibility is limited to real, individual persons only. To be a Referrer, you must be at least 18 years old, and be legally permitted to provide the personal information (e.g., name and email address) of each Referred Customer. The Program cannot be used by businesses for affiliate lead generation or for any other purpose. Employees of Spanx or their subsidiaries, affiliates, or promotional agencies, including immediate family and household members, are not eligible to participate in the Program.
- No Spam. Referrers must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from the Program.
- Right to Close Accounts. Spanx reserves the right to close the account(s) of any Referrer or Referred Customer if the Referrer or Referred Customer attempts to use the Program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.
- Right to Cancel or Change Program or Change Terms. Spanx reserves the right to modify, limit, terminate, discontinue or cancel the Program or to change these Terms & Conditions at any time in its sole discretion. If we change these Terms & Conditions, we will post the updated version on www.spanx.com. Any unclaimed Referral Rewards will be forfeited at that time.
- Privacy. The personal information of each Referrer and Referred Customer will be collected, processed, and used in accordance with Company’s Privacy Policy, which can be found at https://www.spanx.com/our-privacy-policy and Platform Provider’s Privacy Policy, which can be found at http://www.friendbuy.com/privacy. In addition, personal information may be used by Company or Platform Provider, on Company's behalf, to contact any Referrer or Referred Customer with regard to participation in the Program and to receive communications via the Program.
